PRACTICE DIRECTION # SC 2002-1

(CASE MANAGEMENT)

By order of the Chief Justice and with the concurrence of the Judges of the Supreme Court, the following Practice Direction is hereby issued to take effect immediately:

1. The Rules Committee of the Supreme Court has today approved new Rules (the “CPR”) governing the procedure to be followed in civil matters in the Supreme Court. The CPR will come into effect on January 1, 2003.

2. Pursuant to the transitional and other provisions of the CPR (in particular, Part 73) all trial dates scheduled for April 7, 2003 or later will be vacated.

3. As a further transitional measure, and in order to ensure that matters which have already been filed retain their priority, in all pending matters where:

a) the pleadings have been closed;

b) a trial date prior to April 7, 2003 has not been fixed (or if one had been fixed, the trial has been adjourned sine die); and

c) the Parties consent,

one of the parties may apply between now and December 31, 2002, for a Case Management Conference to be held in accordance with the provisions of Parts 25, 26 & 27of the CPR.

4. Copies of Parts 25, 26 & 27 of the CPR can be obtained from the Supreme Court Registry or from the Supreme Court Website at www.sc.gov.jm
